Thousands Rally for Repeal of Alabama’s Extreme Anti-Immigrant Law
Thousands gathered outside the historic 16th Street Baptist Church in Birmingham, Alabama yesterday to demand the repeal of the state’s harsh anti-immigration law, HB 56. Religious, community and civil rights leaders, as well as a special Congressional delegation, urged state legislators to bring an end to Alabama’s immigration law—a law which continues to slow state businesses, separate families and drive immigrants from the state. The Congressional delegation also held an ad hoc hearing at Birmingham City Hall to hear how the controversial law is effecting state residents, especially the Latino and immigrant communities where, according to Rep. Luis Gutierrez, “the feeling of danger and despair is palpable.” One Congressional member, Rep. Al Green of Texas, commented that the law "deserves to be placed on the trash heap of history." House Hearing, New Report Add to Hysterical Narrative on Border Security
It was clear from the outset that Friday’s Congressional hearing on U.S.-Mexico border security was going to be light on data and heavy on bluster. The tabloid-style title of the hearing said it all: “A Call to Action: Narco-Terrorism’s Threat to the Southern U.S. Border.” Not surprisingly, it proved to be a largely fact-free performance. The stars of the show, which was staged by the House Homeland Security Subcommittee on Oversight, Investigations, and Management, were two retired generals: Barry McCaffrey, a former Director of the White House Office of National Drug Control Policy, and Robert Scales, a former Commandant of the United States Army War College. Restrictionist GOP Members Rely on Scare Tactics in Hearing on Prosecutorial Discretion
The luster may be wearing off Republican attacks on DHS’s prosecutorial discretion policies. Efforts to paint the prioritization of cases as “backdoor amnesty” didn’t seem to go anywhere in yesterday’s hearing on immigration enforcement in the Subcommittee on Immigration Policy and Enforcement. ICE Director John Morton defended the prosecutorial discretion guidance he issued earlier this year as “trying to make good calls and good judgments” within a series of tough choices and finite resources. Members opposed to the Administration’s policies had a hard time rebutting the resource point, deciding instead to rely on scare tactics and hyperbolic comparisons to attack the guidance. Read More
Despite Lamar Smith’s Claims, E-Verify Is Not a Jobs Bill
BY TYLER MORAN, NATIONAL IMMIGRATION LAW CENTER While Chairman Lamar Smith (R-TX) promises that his mandatory E-Verify legislation (HR 2885) is a jobs creation bill, the mark-up of the bill in the House Judiciary Committee last week proved that it is anything but. Though the bill passed the committee by a 22-13 party line vote, the debate in committee and amendments offered make it crystal clear the bill would actually yield job losses. The debate leading up to the committee mark up also shows just how fractured conservatives have become on this issue—and much of it focuses on concerns over jobs. Mandatory E-Verify: An Enforcement Proposal Even Conservatives Don’t Like
Rep. Lamar Smith may find himself whistling in the wind this week as members of his own party continue to blast his E-Verify proposal. Smith’s bill, The “Legal Workforce Act” H.R. 2885, which continues to get marked up this week by the House Judiciary Committee, would make E-Verify mandatory nationwide. Conservative lawmakers, Tea Partiers, and Libertarians, however, fear that E-Verify—a electronic system that allows employers to verify work eligibility by checking employee data against Social Security Administration records—will violate civil liberties, hurt small businesses, and destroy the agriculture industry which relies heavily on undocumented labor. Lamar Smith’s HALT Act Would Limit Administration’s Ability to Administer Humanitarian Relief
Today, the House Judiciary Subcommittee held a hearing on the “Hinder the Administration’s Legalization Temptation Act” (HALT Act), introduced by House Judiciary Chairman Lamar Smith (R-TX). The bill, which some are calling a political response to recent ICE memos, would suspend the Administration’s ability to exercise certain discretionary forms of immigration protections and relief until January 21, 2013—the day after the first Obama administration comes to an end. Boston Mayor Threatens to Withdraw from ICE’s Secure Communities Program
The saga surrounding ICE’s Secure Communities program continues this month as Boston Mayor Thomas Menino threatened to withdrawal Boston from the federal program unless the agency agreed to target serious criminals only. Not surprisingly, Boston is just the latest in a series of cities and states—including New York, Illinois, Colorado, DC, and parts of California—that have threatened to drop the program. Even ICE Director John Morton, who recently made a trip to Boston to smooth things over, couldn’t guarantee local police that Secure Communities would focus solely on “serious offenders.” Read More
Senate Hearing on DREAM Act Emphasizes Need for Relief
Today, the U.S. Senate held its first ever hearing on the Development, Relief, and Education for Alien Minors (DREAM) Act. Witnesses such as Department of Homeland Security Secretary Janet Napolitano, Secretary of Education Arne Duncan and Dr. Clifford Stanley, Under Secretary of Defense for Personnel and Readiness, testified to an overflowing Senate hearing room. The hearing renewed hope that despite a failure on the part of the Senate to pass the DREAM Act last year, Congress may yet be willing to help these deserving young adults fulfill their potential and contribute to the U.S. Read More
Sen. McCain Blames Unauthorized Immigrants for Arizona Wildfires
During a press conference Saturday, Sen. McCain blamed undocumented immigrants for the devastating wildfires sweeping through Arizona and southern states, suggesting they started fires to “divert law enforcement agents.” While a U.S. Forest Service official stated there is no evidence suggesting undocumented immigrants are to blame, Sen. McCain, like many restrictionists, took the opportunity to turn tragedy into talking points by exploiting a natural disaster for a sound bite, calling for the need for more border security. Read More

Here we go again with the next round of “how we’re going to look tough on immigration without actually accomplishing anything.” This year, mandatory E-Verify is the magic bullet of choice. On Tuesday, House Judiciary Committee Chairman Lamar Smith (R-TX) introduced the “Legal Workforce Act,” which would expand the E-Verify program, making it mandatory for all employers in the United States.
